1. Who we are

TOS & Partners (Pty) Ltd (“TOS & Partners”, “we”, “us”) is a technology company based in Pretoria, Gauteng, South Africa. For the purposes of POPIA we are the responsible party for personal information collected through this website. Our Information Officer can be contacted at info@tosandpartners.co.za.

2. What we collect

• Information you give us when you complete a demo request or contact form: your name, work email address, organisation, phone number (optional), the service you are interested in and the details of your enquiry.
• Technical information collected automatically by our hosting provider for security and performance, such as IP address, browser type and the pages you visit. This is retained in server logs for a limited period.
• Cookies, as described in section 7 below.

3. Why we collect it

We process personal information to respond to your enquiry, to scope and deliver the demo or services you have asked about, to keep the website secure and reliable, and to meet our legal obligations. We do not sell personal information and we do not use it for automated decision-making or profiling.

4. Lawful basis

We rely on your consent (given when you submit a form or accept cookies), on the need to take steps at your request before entering into a contract, and on our legitimate interest in running a secure, functioning website.

5. Sharing and cross-border transfers

Your information is shared only with service providers who help us operate this website and our email, under contracts that require them to protect it. This website is hosted on infrastructure that may store data outside South Africa; where that happens we ensure the recipient is subject to laws or agreements that provide substantially similar protection, as required by section 72 of POPIA.

6. Retention and security

We keep enquiry information for as long as needed to deal with your request and, if you become a client, for the duration of our relationship and any period required by law. We apply appropriate technical and organisational measures, including encrypted connections (HTTPS), access controls and secure hosting, to protect personal information from loss, misuse or unauthorised access.

7. Cookies

This website uses a small number of cookies and similar technologies:

• Essential cookies that remember your cookie choice and keep the site working. These cannot be switched off.
• Analytics cookies, set only if you choose “Accept all”, that help us understand in aggregate how visitors use the site. No analytics cookies are set if you choose “Essential only”.

You can change your choice at any time using the cookie preferences link in the footer, or by clearing cookies in your browser.

8. Your rights

Under POPIA you have the right to:

• ask what personal information we hold about you and request a copy;
• ask us to correct or delete your personal information;
• object to processing, or withdraw consent you have given;
• lodge a complaint with the Information Regulator (South Africa) at inforegulator.org.za or complaints.IR@justice.gov.za.

To exercise any of these rights, email info@tosandpartners.co.za. We will respond within a reasonable time and in any event within the periods required by POPIA.
